Welcome to ZenithOS. These Terms of Service and End User License Agreement, referred to as the “Terms,” govern your access to and use of the ZenithOS mobile application, website, content, features, subscriptions, coaching tools, artificial intelligence features, fitness programs, nutrition tools, mobility tools, form analysis tools, and related services, collectively referred to as the “App” or “Services.”

By downloading, accessing, creating an account, purchasing a subscription, or using ZenithOS, you agree to these Terms. If you do not agree, do not use the App.

1. License to Use the App

ZenithOS grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, access, and use the App for your own personal health, fitness, nutrition, and wellness purposes.

You may not:

Copy, modify, distribute, sell, lease, sublicense, or exploit the App
Reverse engineer, decompile, disassemble, or attempt to extract source code
Use the App to build a competing product or service
Share your account with others
Use the App in a way that violates laws, regulations, or third-party rights
Interfere with the security, function, or operation of the App

All rights not expressly granted to you are reserved by ZenithOS.

2. Health, Fitness, and Nutrition Disclaimer

ZenithOS provides fitness, nutrition, mobility, recovery, wellness, and educational information for general informational purposes only.

ZenithOS is not a medical provider. The App does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, mental health treatment, or emergency care.

You should consult a qualified healthcare professional before beginning any exercise program, nutrition plan, supplement routine, mobility routine, fasting protocol, recovery protocol, or lifestyle change, especially if you:

Have a medical condition
Are pregnant or breastfeeding
Have a history of injury, pain, illness, or surgery
Take prescription medication
Have dietary restrictions or eating disorder history
Experience chest pain, dizziness, fainting, shortness of breath, severe pain, or unusual symptoms

Use of the App is at your own risk.

3. Exercise and Injury Risk

Physical activity involves risk. By using ZenithOS, you understand and accept that exercise, mobility work, strength training, conditioning, stretching, nutrition changes, and lifestyle changes may result in injury, illness, discomfort, or other health consequences.

You are responsible for listening to your body, using proper form, choosing appropriate intensity, modifying exercises when needed, and stopping immediately if you experience pain, dizziness, shortness of breath, or any concerning symptoms.

ZenithOS is not responsible for injuries, damages, health issues, or losses resulting from your use or misuse of the App.

4. AI Coaching Disclaimer

ZenithOS may include artificial intelligence features, including AI-generated workouts, nutrition feedback, meal analysis, habit suggestions, form feedback, mobility insights, recovery recommendations, and coaching responses.

AI-generated content may be inaccurate, incomplete, outdated, or inappropriate for your specific needs. AI output should not replace professional advice from a certified personal trainer, registered dietitian, physician, physical therapist, or other qualified professional.

You are responsible for reviewing all AI-generated recommendations and deciding whether they are safe and appropriate for you.

5. Nutrition Disclaimer

Nutrition guidance provided through ZenithOS is for educational and general wellness purposes only. The App does not provide medical nutrition therapy or treatment for medical conditions.

Calorie estimates, macro targets, meal feedback, barcode scans, food analysis, and nutrition suggestions may be inaccurate or incomplete. Food databases, AI analysis, labels, and user-submitted data may contain errors.

You are responsible for verifying nutritional information and making choices appropriate for your body, goals, allergies, sensitivities, and medical needs.

6. Form, Posture, and Mobility Analysis Disclaimer

ZenithOS may provide movement, posture, form, or mobility feedback using photos, videos, device sensors, body tracking, or AI analysis.

These tools are educational and informational only. They are not medical evaluations, physical therapy assessments, injury diagnoses, or guarantees of correct movement.

The accuracy of form and mobility analysis may be affected by camera angle, lighting, clothing, visibility, device quality, user positioning, movement quality, and technical limitations.

You should not rely on the App as your sole source of movement safety or injury prevention.

7. Account Registration

To access certain features, you may need to create an account. You agree to provide accurate information and keep your login credentials secure.

You are responsible for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

We may suspend or terminate your account if we believe you violated these Terms or used the App in a harmful, fraudulent, abusive, or unlawful way.

8. Subscriptions, Payments, and Billing

ZenithOS may offer free features, paid subscriptions, trials, one-time purchases, or premium services.

Subscription pricing, renewal terms, and billing details will be shown before purchase. By purchasing a subscription, you authorize the applicable app store or payment provider to charge your selected payment method.

Subscriptions automatically renew unless canceled before the renewal date. You are responsible for managing and canceling your subscription through the platform where you purchased it, such as Apple App Store or Google Play.

ZenithOS does not control app store billing, refunds, or subscription management. Refund requests are handled by the applicable app store or payment provider unless otherwise required by law.

9. Free Trials and Promotions

ZenithOS may offer free trials, discounts, or promotional access. Trial terms will be presented at sign-up.

Unless canceled before the trial ends, your subscription may automatically convert to a paid subscription. Promotional offers may be changed, limited, or discontinued at any time.

10. User Content

You may upload, enter, or submit information to the App, including photos, videos, body metrics, meals, workouts, goals, notes, progress updates, and other content.

You retain ownership of your content. By using the App, you grant ZenithOS a limited license to use, process, store, analyze, display, and transmit your content solely to operate, improve, personalize, and provide the Services.

You agree not to upload content that is illegal, harmful, abusive, hateful, sexually explicit, infringing, misleading, or violates the rights of others.

11. Privacy

Your use of ZenithOS is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and protect your information.

By using the App, you agree that we may collect and process information as described in the Privacy Policy.

12. Acceptable Use

You agree not to use ZenithOS to:

Violate any law or regulation
Harass, abuse, threaten, or harm others
Upload malicious code or attempt to disrupt the App
Access another user’s account without permission
Misrepresent your identity
Scrape, copy, or misuse App content
Use the App for commercial purposes without permission
Attempt to bypass payment, security, or access restrictions

We may suspend or terminate access for violations.

13. Intellectual Property

ZenithOS, including its name, logo, design, text, graphics, features, software, workouts, programs, coaching systems, educational content, and related materials, is owned by Zenith Strong LLC or its licensors.

You may not copy, reproduce, distribute, modify, sell, or create derivative works from ZenithOS content without written permission.

14. Third-Party Services

ZenithOS may integrate with third-party services, including payment processors, app stores, AI providers, analytics providers, wearable devices, nutrition databases, barcode scanners, cloud storage providers, and health platforms.

Your use of third-party services may be governed by their own terms and privacy policies. ZenithOS is not responsible for third-party services, data, errors, outages, or policies.

15. App Store Terms

If you downloaded ZenithOS through the Apple App Store, your use of the App is also subject to Apple’s applicable terms and usage rules. Apple is not responsible for providing maintenance or support for ZenithOS unless required by applicable law.

If these Terms conflict with applicable app store rules, the app store rules may apply to the extent required.

16. Updates and Changes to the App

We may update, modify, suspend, or discontinue any part of ZenithOS at any time. Features may change over time, including AI tools, workout programs, nutrition tools, mobility features, pricing, and subscription offerings.

We are not liable for changes, interruptions, or discontinuation of the App or any feature.

17. Termination

You may stop using ZenithOS at any time. We may suspend or terminate your access if you violate these Terms, create risk, misuse the App, fail to pay required fees, or use the App unlawfully.

Upon termination, your license to use the App ends immediately.

18. Disclaimer of Warranties

ZenithOS is provided “as is” and “as available.” We do not guarantee that the App will be uninterrupted, error-free, secure, accurate, complete, or suitable for your specific goals.

We do not guarantee specific fitness, weight loss, muscle gain, health, mobility, performance, nutrition, or wellness results.

Your results depend on many factors, including consistency, genetics, training history, diet, sleep, stress, medical status, effort, and lifestyle.

19. Limitation of Liability

To the fullest extent permitted by law, ZenithOS, Zenith Strong LLC, its owners, employees, contractors, partners, affiliates, and licensors are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages.

This includes damages related to injury, health outcomes, lost profits, lost data, subscription issues, device issues, AI errors, inaccurate recommendations, service interruptions, or use of the App.

To the fullest extent permitted by law, our total liability for any claim related to the App will not exceed the amount you paid for the Services in the twelve months before the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless ZenithOS, Zenith Strong LLC, its owners, employees, contractors, partners, affiliates, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of law
Your content
Your reliance on fitness, nutrition, AI, mobility, or form recommendations
Your injury, health issue, or damages related to use of the App

21. No Guarantee of Results

ZenithOS may help users improve fitness, nutrition, habits, mobility, performance, and lifestyle, but we do not guarantee any specific result.

Examples of non-guaranteed outcomes include:

Weight loss
Muscle gain
Fat loss
Improved mobility
Improved posture
Pain reduction
Improved lab markers
Improved energy
Improved performance
Improved mental well-being

Your results are your responsibility and may vary.

22. Age Requirements

You must be at least 18 years old to use ZenithOS, or the age of legal majority in your jurisdiction.

If users under 18 are permitted in the future, they must use the App only with consent and supervision from a parent or legal guardian.

23. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App, by email, or by posting updated Terms.

Your continued use of ZenithOS after changes become effective means you accept the updated Terms.

24. Governing Law

These Terms are governed by the laws of the State of Virginia, without regard to conflict of law principles.

Any disputes will be handled in the courts located in Arlington County, Virginia, unless applicable law requires otherwise.
